Planning for the Future: Why Every Family Should Consider a Health Care Proxy

Jul 20, 2026

As a parent or caregiver of a loved one with an intellectual or developmental disability (IDD), you make important decisions every day. But have you thought about who will make health care decisions if your loved one cannot and if you're not available? Planning ahead can provide peace of mind and help ensure your family member's wishes and best interests are respected.

What is a Health Care Proxy?

A Health Care Proxy is a legal document that allows a person to appoint someone they trust to make medical decisions if they are unable to make those decisions themselves. For people with IDD a Health Care Proxy may be an important part of future planning if they have the capacity to make that decision. A qualified professional must determine that the person understands they are appointing someone to make health care decisions on their behalf if needed.

A Health Care Proxy can:

  • Ensure someone you trust can advocate for your loved one's medical needs.
  • Reduce confusion during a medical emergency by identifying who should make decisions.
  • Support person-centered care by helping ensure medical decisions reflect your loved one's values and preferences.
  • Provide peace of mind for families who are planning for the future.

Health Care Proxy or Guardianship?

Many families assume guardianship is the only option, but that isn't always the case.

  • If a qualified professional determines that a person with IDD has the capacity to understand they are appointing someone to make health care decisions if needed, they may be able to complete a Health Care Proxy.
  • If they cannot make informed decisions, other legal options, such as guardianship or New York's surrogate decision-making process, may apply.

Every situation is unique, so it's important to discuss the best option with your care team or legal advisor.
